On March 29, 2021, the Council of the Town of Whitby passed By-law # 7733-21 to require the conveyance of land or the payment of cash-in-lieu thereof for park or other recreational purposes as a condition of the development or redevelopment of land. The by-law applies to the entirety of the Town of Whitby. There are different provisions in the by-law for properties inside the Historic Downtown Whitby Priority Area and for properties outside the Historic Downtown Whitby Priority Area. There are also different provisions in the by-law for high density residential uses outside of the Historic Downtown Whitby Priority Area.
